MY MONTE-CARLO LOYALTY PROGRAMME TERMS AND CONDITIONS

These Terms and Conditions set out the procedures for participating in the My Monte-Carlo Loyalty Programme offered by the Société Anonyme des Bains de Mer et du Cercle des Etrangers à Monaco (hereafter, “SBM”) and for use of the My Monte-Carlo Card as part of the Programme.

1. DEFINITIONS

Member(s): any Resort client (individual, not legal entity) who wishes to participate in the Programme and fulfils the conditions for participation in the Loyalty Programme.

 

My Monte-Carlo Card: means the card produced and issued by SBM to Members when they join the Programme.

 

The Resort: means all of the establishments operated by SBM in the Principality of Monaco and in France (including the Casinos, the Hôtel de Paris Monte-Carlo, the Café de Paris Monte-Carlo, the Hôtel Hermitage Monte-Carlo, the Monte-Carlo Bay Hotel & Resort, the Monte-Carlo Beach, the Thermes Marins Monte-Carlo, etc.).

 

The Casinos: means the Casinos operated by SBM within Monaco (Casino de Monte-Carlo and Casino Café de Paris).

 

My Monte-Carlo Loyalty Account: means the account in which Members’ benefits and points are recorded. The My Monte-Carlo Card can support three types of Loyalty Account:

- Master Account (main account held by the Programme Member)

- Additional Account (joint account)

- Kids Account(s)

 

Counters: the Programme has two counters. These are the My Points counter for reward points that can be spent (“My Points Counter”), and the Status Points counter for statutory points (“Status Counter”).

 

Awarding Establishments: means establishments within the Resort where Members can earn points when they spend money under the conditions set out herein. The list of Awarding Establishments is as follows and is subject to change (any changes will be communicated via the Programme Communications Tools):

- The Casinos

- The Resort’s bars and restaurants

- SBM shops

- Wellness and leisure areas

- Resort hotels

- Concert venues and events organised by SBM

 

The Programme: means the “My Monte-Carlo” marketing strategy aimed at providing Members with benefits, statutory points (“Status Points”) and reward points (“My Points”) when they visit the Resort.

2. FEATURES OF THE MY MONTE-CARLO CARD SUPPORTING THE PROGRAMME

The My Monte-Carlo Card, coded to the Programme, is the property of SBM. The My Monte-Carlo Card is issued to a named cardholder. It is for personal use only and may not be sold or exchanged. The My Monte-Carlo Card is free and cannot under any circumstances be used as a means of payment. Only one Additional Account may be created, together with several Kids Accounts. These must be associated with a Master Account and will all have the same identification number. Only children aged under 18 who have a family relationship with the holder of the Master Account to which their account is linked may hold a Kids Account. The Kids Account has limited functionality, allowing account holders to accumulate and use Points only in participating establishments which the child is permitted to access.

 

3. CONDITIONS FOR PARTICIPATING IN THE PROGRAMME

Anyone over the age of 18 may apply for membership of the Programme and obtain a My Monte-Carlo Card by completing the paper or online form, with their full name, place of residence, email address, phone number, date of birth, nationality, and occupation. For applications in paper format, the completed form must be sent to the My Monte-Carlo Customer Service and Loyalty Team or to the staff at SBM. Once these steps have been completed, the My Monte-Carlo Card coded to the Programme will be issued to the Member solely on presentation of identification at dedicated Resort outlets. Clients who have not completed all of the mandatory fields on the form may not participate in the Programme.

To obtain an Additional Account and/or one or more Kids Accounts, the Member who holds the Master Account and the holder(s) of the Additional or Kids Accounts must complete and sign the relevant forms for each account type. The Member holding the Master Account bears sole responsibility for the use of the associated Additional and Kids accounts and for any changes made to these Accounts (change of account holder or deletion of Account), which should be notified immediately.

 

4. CONDITIONS FOR AWARDING STATUS POINTS AND/OR MY POINTS UNDER THE PROGRAMME

4.1 The Programme allows the Member, via the Master, Additional or Kids Accounts, to accumulate points on the Status Points Counter and/or the My Points Counter. The Master Account and Additional Account accumulate points depending on amounts gambled in the Casinos (Table Games, Slot Machines, Video Poker Games and Electronic Table Games) and amounts spent in Awarding Establishments. Points may also be accumulated as a result of SBM’s commercial decisions. The Kids Account is operated according to separate rules, since points may only be accumulated in establishments to which children have access. As such, the rules set out below only apply to the Kids Account where the establishment concerned is accessible to children. Under no circumstances may legal entities, even if managed or represented by the Member or the holders of Additional Accounts, accumulate Points by any means whatsoever. 

 

4.2 Each gaming session on Table Games and/or Slot Machines, Video Poker Games and Electronic Table Games (provided the My Monte-Carlo Card has been inserted into the Slot Machine, Video Poker Game or Electronic Table Game and/or presented to the member of staff supervising the table game at the beginning of the gaming session), and each purchase made at an Awarding Establishment (provided the My Monte-Carlo Card is presented) results in the award of Status Points and/or My Points, and the Counters will be updated accordingly, based on the scale indicated in point 4.5 below. Members may consult their My Points and Status Points balance via the Programme Communications Tools.

This rule applies only to products and services provided by the Awarding Establishments as detailed in the Programme Communications Tools and these Terms and Conditions. Points cannot be earned on the following products and services:

- Tobacco products, newspapers and magazines, and items sold on consignment in SBM shops;

- Payments made for concierge services during stays;

- Events in aid of charitable causes, in particular admission to ticketed events, and all expenses incurred during such events.

 

4.3 The Programme is divided into four (4) status levels (presented in ascending order of the number of Status Points required to reach the level):

SILVER 5,000 Status Points

GOLD 22,500 Status Points

PLATINUM 175,000 Status Points

Members move from one status level to the next in accordance with the number of Status Points they have accumulated during the course of a calendar year (1 January to 31 December). Each status level is associated with a set of Status Benefits detailed and published via the Programme Communications Tools.

 

4.4 The My Points Counter allows Members to accumulate My Points, which can be used immediately by presenting the My Monte-Carlo Card as described below, or exchanged for/converted into services according to the conditions defined hereafter.

Each My Point accumulated on the My Monte-Carlo Card is valid until 31 December of the year following the year in which it was accumulated. After this date, the point is irretrievably lost.

Status Points are accumulated from 1 January to 31 December of each year. Status Points accumulated over the course of one year give the Member access to the various Status levels.

On 1 January of each year, the Member’s Status Point total is reset to zero, but they retain the Status attained the previous year. Over the next year, in order to attain the next Status level up, the Member must accumulate all of the Status Points required to attain their current level AND those required to attain the next level up, as their Status Points counter will have been reset to zero.

If, during this new year, the Member fails to accumulate the number of Status Points required to attain their current Status level, they will lose this Status level the following year and will be awarded the Status level corresponding to the number of Status Points actually accumulated over the year.

 

4.5 Points scale

As noted above, My Monte-Carlo Programme Members enjoy a points programme that rewards their spending (as well as that of any Additional or Kids Accounts) in the Resort. My Points and Status Points are collected according to the procedures set out below, which vary depending on the Member’s Status.

Points are acquired:

- When playing Table Games: Members identify themselves on arrival at the table by presenting their Card to the member of staff, who assesses the amount of time the Member spends playing and their average bets. Based on this assessment, Status Points and My Points are acquired.

- When playing Slot Machines, Video Poker Games and Electronic Table Games, points are awarded according to the scale set out below (provided the My Monte-Carlo Card has been inserted as stipulated in clause 4.2 above):

Video Poker Games – excluding exceptions: For every €7.50 that a Member bets in actual euros (not promotional credit), they will receive 1 My Point and 1 Status Point.

Electronic Table Games – excluding exceptions: For every €4.50 that a Member bets in actual euros (not promotional credit), they will receive 1 My Point and 1 Status Point.

Fruit Machines – excluding exceptions: For every €3.00 that a Member bets in actual euros (not promotional credit), they will receive 1 My Point and 1 Status Point.

Machines not participating in the points programme - specified on-site: no points will be credited, regardless of the amount bet.

- When making purchases in Resort bars and restaurants, wellness areas and SBM boutiques and drugstores (for products other than tobacco, newspapers and magazines, and items sold on consignment) or attending shows and concerts organised by SBM (excluding charity events): For every €0.60 spent by the Member in actual euros (excluding payments made using My Points or invitations), they will receive 1 My Point and 1 Status Point, provided the Card is presented at the same time as payment is made.

- When paying for a stay at one of the Resort hotels, subscription packages at the ‘Beach Bains’ or services at the Monte-Carlo Kids Club: For every €0.60 spent by the Member in actual euros (excluding payments made using My Points or invitations), they will receive 1 Status Point, provided the Card is presented at the same time as payment is made.

Where the Member charges the bar/restaurant bill to their room, Status Points and/or My Points will be awarded on actual payment of the bill.

Exceptionally and for promotional purposes, events which allow Members to acquire My Points and/or Status Points outside the rules and other than at the points of sale noted above may be arranged. Members to whom these promotions apply will be informed of such events via the Programme Communications Tools.

SBM reserves the right to change the Points scales set out in this clause. Programme Members will be informed of any such changes via the Programme Communications Tools.

 

5. USE OF MY POINTS AND OTHER BENEFITS

Members regularly receive offers from the Programme and Resort establishment free of charge, by email or SMS.

Members may use some or all of their My Points by presenting the My Monte-Carlo Card and/or associated Additional or Kids Accounts, exclusively in participating Resort establishments (an up-to-date list is available via the Communications Tools), for the duration of the My Points validity period as defined in clauses 4 and 6 of these Terms and Conditions, in the manner indicated below (subject to any changes indicated in the Programme Communications Tools). The holder of the Master Account bears sole responsibility for the use of My Points by the Master Account holder or by associated Additional or Kids Accounts, and the locations and times of use. My Points cannot be given to our staff as tips.

 

5.1 Use of My Points (1 point = 1 euro cent): available exclusively in participating Resort establishments (an up-to-date list is available via the Communications Tools). The My Monte-Carlo Card must be presented when using My Points, for participating products and services only.

 

5.2 Use of My Points in exchange for a voucher or specific action carried out by Programme staff: Programme benefits are reserved strictly for Members. Members may ask the My Monte-Carlo Customer Service and Loyalty Team or Casino staff to exchange their My Points for services and benefits in the following areas: some Slot Machines, Video Poker Games and Electronic Table Games, restaurants, wellness and leisure areas, shops, concerts and performances, and for purchasing Status Points.

• Free slot machine games: Transfer carried out manually by staff or the My Monte-Carlo Customer Service and Loyalty Team. My Points may be converted into free games, with a minimum of 500 My Points to be exchanged per transaction. The period of validity for free games is the same as that for Points (as stipulated in clause 4.4). To obtain their benefit, the Member must insert their card into the Machine’s reader, enter their PIN code, and request a My Points transfer up to the daily limit defined by the Casino Management.

• Concerts and performances: Manual discount applied by staff or the My Monte-Carlo Customer Service and Loyalty Team when making the reservation for the Member (excluding charity events).

Only points accumulated and showing in the My Points Account on the date of the request can be exchanged, in accordance with the conditions stipulated above, by contacting the My Monte-Carlo Customer Service and Loyalty Team or authorised Resort staff.

 

5.3 In the event that the My Points balance is insufficient at the time of payment of the relevant bill, the Member must settle the remaining amount due immediately by a payment method of their choice (except where the client is staying at the Resort, in which case the client may defer payment by charging the unpaid amount to their room to be settled at check-out).

Example: For a bill of €110 (= 11,000 My Points), if the Member has a sufficient balance of 11,000 My Points on their Card, the Member may choose to:

- Use the 11,000 My Points

- Pay the bill (by a payment method of their choice, including charging it to their hotel room) and keep the My Points on their Card

- Use only a portion of their My Points and pay the remaining balance (by a payment method of their choice, including charging it to their hotel room)

In the event that a Member owes a sum of money to SBM for any reason, and the My Monte-Carlo Card coded to the Programme has a balance sufficient to cover this sum, SBM reserves the right to automatically apply all or part of this balance to the sum due.

My Points and Status Points may not be exchanged, reimbursed or transferred, and no compensation or change will be given.

Points are the property of SBM. They are made available to Members on a personal (non-transferable) basis, and SBM may unilaterally decide to withdraw or change the value of points, having informed the Member in advance. SBM also reserves the right to suspend a Member’s right to acquire or use Account Points at its discretion. Kids Account holders may only use My Points in participating establishments for products and services which they may legally access.

 

6. MY MONTE-CARLO CARD VALIDITY PERIOD

The My Monte-Carlo Card coded to the Programme is valid for the duration of the Programme as long as it continues to be used. If the Card is not used for a period of three years, participation in the Programme may be unilaterally terminated by SBM at its discretion. The My Monte-Carlo Card will be deactivated, the Member Account and, where applicable, associated Additional and Kids Accounts will be closed, and the Points will be lost. The Member accepts this provision unconditionally.

 

7. LOSS/THEFT OF MY MONTE-CARLO CARD

Loss or theft of the My Monte-Carlo Card, or damage which renders the Card unusable, must be reported by the Member:

- To the My Monte-Carlo Customer Service and Loyalty Team or a dedicated member of Resort staff

The My Monte-Carlo Card will be deactivated immediately and will no longer be able to be used. A new My Monte-Carlo Card will be issued to the Member and linked to their Account. The Points registered on the My Monte-Carlo Card Account will be those accumulated as of the date the loss/theft/damage was declared. SBM may not under any circumstances be held liable for Points which could not be recorded before the date on which the Member made the declaration, or for any use of the Card by a third party before this time.

Cards are issued free of charge by SBM. SBM may make a charge for a third and any subsequent reissues of Cards requested by the Member within a single calendar year from the date of the last issue. This charge will be €10.00 (including VAT) and can also be paid by the Member in My Points at the prevailing My Points value. The only circumstances under which SBM will not apply this charge will be where a Card is reissued for technical reasons.

 

8. LIABILITY

SBM accepts no liability for improper or fraudulent use of the My Monte-Carlo Card or Points, or for any damage resulting from or connected with the services or benefits provided as part of the Programme.

SBM reserves the right to resort to all means of redress in the event of fraudulent use or misuse of the My Monte-Carlo Card, including in cases where direct or indirect harm is caused to the company or its employees.

Any breach of the Terms and Conditions of Use and any falsification of information provided to SBM will automatically cause the membership contract to be terminated. The Member will also be removed from the Programme and their Points cancelled.

 

9. CHANGES TO TERMS AND CONDITIONS/SUSPENSION OF LOYALTY PROGRAMME

SBM may, at any time, at its discretion, decide to amend or add to these Terms and Conditions. Such amendments and/or additions will apply automatically and immediately to Members from the time they are published and/or posted online via the Programme Communications Tools. In the event of a discrepancy between these Terms and Conditions and any other document, including commercial documents, these Terms and Conditions shall prevail. SBM also reserves the right to suspend, change or terminate the Programme at any time without notice.

My Monte-Carlo Programme Members will be informed of such events by SBM using any appropriate means that the company chooses: by email, by post, by displaying the information in SBM establishments or more generally via the Programme Communications Tools. No changes, including termination of the Programme, will entitle Members to compensation of any kind.

 

10. PROTECTION OF PERSONAL INFORMATION

Confidentiality and the protection of customers’ personal information are priorities for SBM.

As data controller, SBM processes personal data mainly for the purpose of managing membership of the Programme and providing services.

This also includes managing offers, tracking benefits and, more broadly, the entire commercial relationship (signing up to receive SBM communications, consultations, bookings, orders, subscriptions, loyalty accounts, surveys, commercial and information communications, statistics).

SBM may also use Members’ data to evaluate and improve its services and to develop new services, as well as to implement customer loyalty and acquisition initiatives, surveys, and tailored promotions.

Information marked with an asterisk (*) must be provided in order to open your Account. The Member and their spouse or child(ren) will not be able to activate their Accounts (and thus join the Programme) if they refuse to provide the information requested.

This processing is justified by:

- The legitimate interest of the data controller, specifically for ensuring the loyalty of clients and providing them with a personalised experience at the SBM Resort;

- The consent of the data subject, who wishes to join the loyalty programme and enjoy its benefits.

With your express consent, SBM may therefore send you commercial information about services that are different to those already provided, via all communications channels that you have provided for this purpose.

Personal data collected are intended for SBM.The personal information collected is for SBM but also for third parties acting on behalf of SBM and approved by SBM. Its processing is based on the prior instructions of SBM set down in a contract in accordance with the law.

These data will be kept only for as long as is necessary for these purposes, and for a period of no more than three years after the end of the commercial relationship. However, SBM may keep your data beyond this period to fulfil its legal obligations (including with respect to efforts to combat fraud and money laundering), to respond to requests from government and public authorities, and to assert, exercise or defend its legal rights.

In accordance with Regulation (EU) 2016/679 of 27 April 2016 and Monegasque Act No. 1,165 of 23 December 1993, as amended, you have the right to access and rectify your data at any time, ask for them to be deleted, object to processing of your data for legitimate reasons due to your particular circumstances, or exercise your right to data portability, by sending an email and proof of your identity to: [email protected], or by writing to: My Monte-Carlo Programme, Casino de Monte-Carlo, MC 98000 (Principality of Monaco).

If, after contacting the data controller, you believe your rights have been infringed, you may submit a claim to the French authority, the Commission Nationale de l'Informatique et des Libertés (CNIL.fr), or the Monegasque authority, the Commission de Contrôle des Informations Nominatives (CCIN.mc).

12. DISPUTES

These Terms and Conditions are governed by Monegasque law. Any dispute which may arise with regard to their interpretation or performance will be subject to the exclusive jurisdiction of the  courts of Monaco.
