2.  FEATURES OF THE MY MONTE-CARLO CARD SUPPORTING THE PROGRAMME

The My Monte-Carlo Card, coded to the Programme, is the property of SBM. The My Monte-Carlo Card is issued to a named cardholder. It is for personal use only and may not be sold or exchanged. The My Monte-Carlo Card is free and cannot under any circumstances be used as a means of payment. Only one Additional Account may be created, together with several Kids Accounts. These must be associated with a Master Account and will all have the same identification number. Only children aged under 18 who have a family relationship with the holder of the Master Account to which their account is linked may hold a Kids Account. The Kids Account has limited functionality, allowing account holders to accumulate and use points only in participating establishments which the child is permitted to access.

3. CONDITIONS FOR PARTICIPATING IN THE PROGRAMME

Programme membership and My Monte-Carlo Cards are available on request to persons aged over 18 who complete and sign a form providing their full name, postal address, email address, date of birth, and nationality. The form should then be submitted to the My Monte-Carlo Customer Service and Loyalty Team or to SBM staff. Once these steps have been completed, the My Monte-Carlo Card coded to the Programme will be issued to the Member on presentation of identification. Clients who have not completed all of the mandatory fields on the form or presented identification may not participate in the Programme.

To open an Additional Account and/or one or more Kids Account(s), additional identity forms for each individual must also be completed and signed. The Member holding the Master Account bears sole responsibility for the persons he or she designates as holders of Additional and/or Kids Accounts, as well as for any changes to these Accounts (change of account holder or deletion of account), which should be notified immediately.

4. CONDITIONS FOR AWARDING PROGRAMME LOYALTY POINTS AND/OR MY POINTS

4.1 The Programme allows the Member, via the Master, Additional or Kids Accounts, to accumulate points on the Loyalty Points Counter and/or the My Points Counter. The Master Account and Additional Account accumulate points depending on the amount of gaming in the Casinos (table games, slot machines, video poker games and electronic table games) and expenditure in Awarding Establishments. Points may also be accumulated as a result of SBM’s commercial decisions. The Kids Account is operated according to separate rules, since points may only be accumulated in establishments to which children have access. As such, the rules set out below only apply to the Kids Account to the extent to which the establishment concerned is accessible to children.

4.2 Each gaming session on table games and/or slot machines, video poker games and electronic table games (provided that the My Monte-Carlo Card has been inserted into the slot machine, video poker game and electronic table game and/or presented to the member of staff supervising the table game at the beginning of the gaming session), and each purchase made at an Awarding Establishment (provided that the My Monte-Carlo Card is presented in accordance with the conditions set out in clause 4.5 below) results in the award of Loyalty Points and/or My Points, and the Counters will be updated accordingly.  Members may consult their My Points and Loyalty Points balance via the Programme Communications Tools.

This rule applies only to products and services that are part of the points collection programme. These are detailed in the Programme Communications Tools. Points cannot be earned on the following products and services:

-              Tobacco products, newspapers and magazines, and items sold on consignment in the shops

-               Subscription packages for wellbeing and recreation areas

-               Concierge costs during hotel stays and extras purchased in the Resort Hotels

4.3 The Programme is divided into four (4) status levels (presented in ascending order of the number of Loyalty Points required to reach the level):

MEMBER : 0 Loyalty Points

SILVER : 5 000 Loyalty Points

GOLD : 22 500 Loyalty Points

PLATINIUM : 175 000 Loyalty Points

Members move from one status level to the next in accordance with the number of Loyalty Points they have accumulated during the course of a calendar year (1 January to 31 December). Each status level is associated with a set of Status Benefits detailed and published via the Programme Communications tools.

4.4 The My Points Counter allows Members to accumulate My Points, which can be used immediately by presenting the My Monte-Carlo Card as described below or exchanged for/converted into services according to the conditions defined hereafter.

Each My Point accumulated on the My Monte-Carlo Card is valid until 31 December of the year following the year in which it was accumulated. After this date, the point is irretrievably lost.

Each year, Loyalty Points are built up from 1 January to 31 December, and reset to zero on 1 January. Loyalty Points accumulated during the period of validity described above enable the Member to change his or her status level if the required Loyalty Points threshold is reached to allow the Member to move up to the next status above their current level. If this threshold is not reached, the Member retains his or her existing status. When a Member moves to another status level, the Loyalty Points Counter continues to increase. Members retain the final status reached until 31 December of the following year, on which date the number of points accumulated during that calendar year will be reviewed. The status will then be retained if the required number of Loyalty Points has been accumulated. If this is not the case, the Member will be granted the status matching the number of points actually accumulated during this period.

Example: where a Member accumulates 7,000 Loyalty Points by 15 May of year N, he or she obtains Silver Status on that date. If the Member goes on to reach 23,000 Loyalty Points by 15 July of the same year N, he or she moves up to Gold Status. On 31 December of year N, the Member has 35,000 Loyalty Points. On 1 January of the year N+1, the Member will have a points balance of zero but retain their Gold Status until 31 December of N+1, unless he or she accumulates the required number of Loyalty Points to move up to the next status, Platinum, during N+1.

 4.5 Points scale

As noted above, My Monte-Carlo Programme Members enjoy a points programme that rewards their consumption (as well as that of any Additional or Kids Accounts) in the Resort. My Points and Loyalty Points are collected according to the procedures set out below, which vary depending on the Member’s status.

Points are acquired:

-               When playing table games: Members identify themselves on arrival at the table by presenting their Card to the member of staff, who assesses the amount of time Members spend playing and their average bets. Based on this assessment, Loyalty Points and My Points are acquired.

-               When playing slot machines, video poker games and electronic table games, points are awarded according to the scale set out below (provided that the My Monte-Carlo Card has been inserted as stipulated in clause 4.2 above):

Video Poker Games – excluding exceptions: For every €7.50 that a Member bets in actual euros (not promotional credit), he or she will receive 1 My Point and 1 Loyalty Point

Electronic Table Games – excluding exceptions: For every €4.50 that a Member bets in actual euros (not promotional credit), he or she will receive 1 My Point and 1 Loyalty Point;

Slot Machines – excluding exceptions: For every €3.00 that a Member bets in actual euros (not promotional credit), he or she will receive 1 My Point and 1 Loyalty Point

Machines which are not part of the points collection programme –specified on site: no points will be credited, regardless of bet volume on condition that the Card is presented at the same time as payment is made.

-                When visiting one of the casino bars or restaurants: for every €0.60 spent by the Member in actual euros (excluding payments made using My Points or invitations), the member will receive 1 My Point and 1 Loyalty Point, on condition that the Card is presented at the same time as payment is made.

-               When visiting one of the hotels (overnight stays or hotel services), and in the wellbeing and swimming pool areas (subscription packages): for every €0.60 spent by the Member in actual euros (excluding payments made using My Points or invitations), he or she will receive 1 Loyalty Point, on condition that the Card is presented at the same time as payment is made.

-  When visiting one of the Resort bars or restaurants (outside the casinos), in the wellbeing and swimming pool areas (products other than subscription packages), the SBM drugstore and shops (products excluding tobacco products, newspapers/magazines, and products sold on consignment) and for shows organised by SBM: for every €0.60 spent by the Member in actual euros (excluding payments made using My Points or invitations), he or she will receive 1 Loyalty Point, regardless of his or her status, on condition that the Card is presented at the same time as payment is made. Members with Silver or higher status will receive 1 Loyalty Point and 1 My Point.

Where the Member charges the bar/restaurant bill to his or her room, Loyalty Points and/or My Points will be awarded on actual payment of the bill.

Exceptionally and for promotional purposes, events which allow Members to acquire My Points and/or Loyalty Points outside the rules and other than at the points of sale noted above may be arranged. Members to whom these promotions apply will be informed of such events via the Programme Communications Tools.

SBM reserves the right to change the points scales set out in this clause. Programme Members will be informed of any such changes via the Programme Communications Tools.

5. USE OF MY POINTS AND OTHER BENEFITS

Members regularly receive, free of charge, by post, email or text message depending on the preference they expressed on their Programme membership form, offers from the Programme and establishments operating within the Resort.

My Points can be used upon mandatory presentation of the My Monte-Carlo Card by the Member and/or holders of the associated Additional or Kids Accounts, exclusively within participating establishments at the Resort (an updated list is available via the Communications Tools). Points may be used all at once or on several occasions throughout the period during which the My Points are valid, as stipulated in clauses 4 and 6 of these Terms and Conditions, and in accordance with the conditions set out below (and any conditions updated via the Communications Tools). The holder of the Master Account bears sole responsibility for the ways in which My Points are used by the Master Account holder or by associated Additional or Kids Accounts, and the locations and times of use. My Points cannot be given to our staff as tips.

5.1 Use of My Points with equivalent euro value (1 point = 1 euro cent): available exclusively in participating establishments at the Resort (a list is available and updated via the Communications Tools). The My Monte-Carlo Card must be presented when using My Points, on participating products and services only.

5.2 Use of My Points in exchange for a voucher or specific action carried out by Programme staff:

Programme benefits are strictly reserved for the use of Members.

Members may ask the My Monte-Carlo Customer Service and Loyalty Team or Casino staff to exchange their My Points for services and benefits in the following areas: some slot machines, video poker games and electronic table games, restaurants, wellbeing and recreation areas, shops, performances, and for purchasing Loyalty Points.

•              Free slot machine games: Transfer carried out manually by staff or the My Monte-Carlo Customer Service and Loyalty Team. My Points may be converted into free games, with a minimum of 500 My Points to be exchanged per transaction. The period of validity for free games is the same as that for points (as stipulated in clause 4.4). To make use of the benefit, the Member must insert their Card into the machine’s reader and enter his or her PIN number.

•               Monte-Carlo SBM shops: Issue of a voucher by staff or the My Monte-Carlo Customer Service and Loyalty Team. My Points may be converted into SBM shop vouchers, with a minimum of 500 My Points to be exchanged per transaction. An expiry date will be indicated on the voucher. To obtain the product, the Member must present the voucher at the cash registers of the establishments noted above. The Member alone is responsible for retaining the voucher. Vouchers cannot be exchanged for cash and no change will be given. Vouchers cannot be exchanged, reimbursed or reprinted, and are valid until the expiry date indicated.

•   Performances, restaurants, wellbeing and recreation: Manual discount carried out by staff or the My Monte-Carlo Customer Service and Loyalty Team when making the reservation for the Member.

Only points accumulated and showing in the My Points Account on the date of the request can be exchanged, in accordance with the conditions stipulated above, by contacting the My Monte-Carlo Customer Service and Loyalty Team or Casino staff.

5.3 In case that the My Points balance is insufficient at the time of payment of the relevant bill, the Member must settle the remaining amount due immediately by a payment method of his or her choice (except if the client is staying at one of our hotels, in which case the client may defer payment by charging the unpaid amount to his or her room to be settled at check-out).

Example: For a bill of €110 (= 11,000 My Points), if the Member has a sufficient balance of 11,000 My Points on his or her Card, the Member may choose to:

-               Use the 11,000 My Points

-               Pay the bill (by a payment method of his or her choice, including charging it to their hotel room) and keep the My Points on his or her Card

-  Use only a portion of the My Points and pay the remaining balance by a payment method of his or her choice, including charging it to their hotel room

In case that a Member owes a sum of money to SBM for any reason, and the My Monte-Carlo Card coded to the Programme has a balance sufficient to cover this sum, the Member authorises SBM to automatically apply this balance to the sum due.

My Points and Loyalty Points may not be exchanged, reimbursed or transferred, and no compensation or change will be given. Every My Point is valid for use by the Member on the Master Account.

Points are the property of SBM. They are made available to clients on a personal (non-transferable) basis, and SBM may unilaterally decide to withdraw or change the value of points, having informed the Member in advance. SBM also reserves the right to suspend a client’s rights to acquire or use Account Points at its discretion.

Kids Account holders may only use My Points in participating establishments for products and services to which they legally and conventionally have access.

6. MY MONTE-CARLO TERM OF VALIDITY

The My Monte-Carlo Programme replaces all other SBM loyalty programmes in the Resort.

On this date, all cards relating to any other Resort programmes will be deactivated and any benefits transferred to the new My Monte-Carlo Card.

The My Monte-Carlo Card coded to the Programme is valid for the duration of the Programme as long as it continues to be used. If the Card is not used for a period of 2 years, participation in the Programme may be unilaterally terminated by SBM without giving a specific reason. The My Monte-Carlo Card will be deactivated, the Member Account and, where applicable, associated Additional and Kids Accounts will be closed, and the points will be lost. The Member accepts this provision unconditionally.

7. LOSS/THEFT OF MY MONTE-CARLO CARD

Loss or theft of the My Monte-Carlo Card, or damage which renders the Card unusable, must be reported by the Member:

-               By telephoning +377 98 06 27 27 or +377 98 06 55 55

-              To the My Monte-Carlo Customer Service and Loyalty Team or a dedicated member of staff in the Casinos

The My Monte-Carlo Card will be deactivated immediately and will no longer be able to be used. A new My Monte-Carlo Card will be issued to the Member and linked to his or her Master Account. The points registered on the My Monte-Carlo Card Account will be those accumulated as of the date the loss/theft/damage was declared (providing that the points are still valid). SBM may not under any circumstances be held responsible for points which could not be recorded before the date on which the Member made the declaration, or for any use of the Card by a third party before this time.

Cards are issued free of charge by SBM. SBM may make a charge for a third and any subsequent reissues requested by the Member within a single calendar year from the date of the last issue. This charge will be €10.00 (including VAT) and can also be paid by the Member in My Points at the prevailing My Points value. The only circumstances under which SBM will not apply this charge will be where a Card is reissued for technical reasons (except in cases where there is physical damage to the Card).

8. LIABILITIES

SBM accepts no liability for improper or fraudulent use of the My Monte-Carlo Card or points, or for any damage resulting from or connected with the services or benefits provided as part of the Programme.

SBM reserves the right to resort to all means of redress in the event of fraudulent use or misuse of the My Monte-Carlo Card, including in cases where direct or indirect harm is caused to the company or its employees.

Any breach of the Terms and Conditions of Use or provision of false information to SBM will result in automatic termination of the membership contract, expulsion of the Member and cancellation of his or her benefits in terms of points collected.

9. CHANGES TO TERMS AND CONDITIONS/SUSPENSION OF LOYALTY PROGRAMME

SBM may, at any time, at its discretion, decide to amend or add to these Terms and Conditions. Such additions and/or amendments will apply automatically and immediately to Members from the time they are published and/or posted online via the Programme Communications Tools. In the event of a discrepancy between these Terms and Conditions and any other document, including commercial documents, these Terms and Conditions shall prevail. SBM also reserves the right to suspend, change or terminate the Programme at any time without notice. My Monte-Carlo Card Members will be informed of such events by SBM using any appropriate means that the company chooses: by email, by post, by displaying the information in SBM establishments or more generally via the Programme Communications Tools.

No changes, including termination of the Programme, will give Members any right to compensation.
