General Sales Terms and Conditions – accommodation bookings

1. Preamble

 

Société Anonyme des Bains de Mer et du Cercle des Etrangers à Monaco (“SBM”), whose registered office is at Place du Casino – 98000 Monaco, operates a resort under the name “Monte-Carlo Société des Bains de Mer” in the Principality of Monaco and in France (the “Resort"), including Monaco casinos, hotels, restaurants, wellness centres, bars and discotheques, and real estate.

 

You, as a private individual and a non-trading natural person, by making an individual reservation at one of the SBM Resort Hotels (“Hotel”), confirm that you are an adult with legal capacity to enter into a contractual agreement (“you” or the “Guest”). You undertake to make a reservation for yourself and not to act on behalf of other persons or to assign the reservation rights to any third party, whether with or without valuable consideration. Consequently, any agency wishing to make a reservation on behalf of its customer must contact SBM’s customer service department (“Customer Service Department”) directly.

 

You may make a reservation for up to eight (8) rooms at the Resort Hotels. To book more than eight (8) rooms, or for group reservations or seminars, you are invited to visit the website / contact the Sales Department - Place du Casino, BP 139, 98000 Monaco – Principality of Monaco – 98000 Monaco – [email protected].

 

By confirming a reservation made on the SBM website or with the SBM Customer Service Department, you unreservedly accept these terms and conditions (the “Terms and Conditions”).

2. Purpose

 

These Terms and Conditions define your rights and obligations, and those of SBM, for all reservations made by you and confirmed by SBM. 

 

SBM reserves the right to complete the Terms and Conditions at any time, and the version of the Terms and Conditions applicable to you is the version in force when the reservation is confirmed (available on the website). 

 

3. Making a reservation

 

You may make a reservation either on the SBM website, or by contacting the Customer Service Department by phone or email, on the number or at the address shown in Article 17.

 

You choose the services provided by SBM at the Resort Hotels solely and at your own exclusive liability, and acknowledge that you have read the descriptions of each service booked. You choose services and the dates of your stay at the Resort Hotels from a range of price options.

 

By confirming your reservation, you unreservedly accept the prices and descriptions of the services. 

When booking on the SBM website, a reservation summary will be displayed prior to confirmation.

When booking through the Customer Service Department , you will be sent a reservation email (offer or confirmation).

To confirm your reservation, you should read the Terms & Conditions and enter your bank card details in the relevant fields (on the website) or provide your bank details (directly) in order to make a deposit or to prepay, depending on the services booked. If you are prepaying, you will sent a secure link.

Once your bank card details have been verified by your banking institution, the institution concerned will send email confirmation to definitively confirm the reservation.

The Hotel reserves the right to debit your bank card for the entirety of your stay, as indicated in Articles 11 and 12. Prepayment in full is required for stays of more than ten (10) nights, or for certain products and offers.

Any non-payment, refusal, or invalidity in the payment procedure or in verification with banking or credit institutions will cause the reservation to be cancelled automatically.

4. Payment

 

On arriving at the Hotel, you must present proof of identity and the bank card used to make the reservation at the Hotel’s reception desk.

 

You acknowledge that any prepayment or payment debited at the time of reservation will be treated as a non-refundable deposit for a non-modifiable, non-refundable reservation, in accordance with the cancellation policy described in Article 11.

 

During your stay, you may not seek any refund or replace the payment method used to make the reservation.

 

On arriving at the Hotel, the Hotel will process a pre-authorisation of your bank card, to guarantee payment of the products and services you use during your stay.

 

For stays of more than seven (7) nights, the Hotel will prepare an invoice for all of the hotel services used over each period of seven (7) nights. You must pay each of these invoices in order to continue your stay.

 

You may pay for your stay using the following payment methods:

euro-denominated cheque or cash not exceeding the statutory limit, bank card in your name, or wire transfer (you must be the payee).

 

You must pay for your stay before checking out of the Hotel.

 

Rates are expressed and payable in euros. Any payment in foreign currency shall be subject to the rate applied by the Hotel.

Amounts shown on reservation do not include the tourist tax or any additional services, which must be paid for directly to the Hotel when checking out.

 

SBM reserves the rights to make a record of any non-payment, refuse any future reservations, and take action to collect any sums due.

5. Check-in and check-out

 

The Hotel welcomes you for check-in from 3 pm onwards (or 4 pm for certain venues). Please refer to the website for details of specific check-in and opening hours for the Monte-Carlo Bay Hotel.

 

At the end of your stay, you must check out before midday.

 

If the Hotel agrees to allow you to check in earlier or check out later, you will be charged 50% (fifty percent) of the room rate for one extra night, in addition to the price of your stay. If you check out after 4 pm, you will be charged 100% (one hundred percent) of the room rate for one extra night, in addition to the price of your stay.

6. Your stay

On arriving at the Hotel, you, along with any adults and children accompanying you, will be required to complete a police form and produce valid proof of identity.

 

You may connect up to two devices to the free Wi-Fi (up to 3 Mbps) provided.

 

On arriving at the Hotel, you will receive a person “Monte-Carlo Pass®” card bearing your name.

 

You may use this card to:

  • Open the door to your hotel room,
  • Access the free Wi-Fi provided (3 mbps, up to two devices simultaneously), 
  • Charge all of your spending at the Resort to your room account,
  • Access all of the shuttle transfers provided at the Resort free of charge.

7. Rules and regulations

 

Any inappropriate or disorderly behaviour that contravenes the rules of the Hotel concerned (a copy of which is available from the Hotel’s reception desk), or behaviour that may cause loss or injury to SBM, may result in you being asked to leave the premises, without compensation. SBM may still require you to pay for your stay in full and pursue action to obtain compensation for any loss or injury sustained.

8. Packages

For hygiene and safety reasons, packages received by the Hotel and addressed to Guests must be opened by the Guest concerned, in the presence of an SBM staff member. SBM reserves the right to prohibit packages from being opened and/or their contents from being brought into and used on the premises, if they pose a risk to the hygiene and/or safety of the establishment or its Guests. SBM also reserves the right to refuse to store packages on its premises, even sealed, where there is a hygiene and/or safety risk. In this case, the Guest concerned must take steps to have the package removed immediately. If a Guest has a package or letter delivered to a Hotel before or during their stay, SBM may under no circumstances be held liable for any incident or damage to packages, or any other delivery issue, such as an incorrect number of packages. The Guest concerned should contact their supplier or shipper directly in the event of a problem. Guests are also responsible for any customs fees or duties payable on receipt of a package and must pay the shipper where applicable, before checking out of the Hotel.

9. Additional services

 

If your reservation does not include breakfast, you may use the Hotel’s restaurant or order breakfast from room service, subject to an additional charge at the applicable rate.

 

Cots (for infants aged 0 to 2 years) are available on request from the Hotel, at no extra charge.

 

In all Resort hotels (except the Monte-Carlo Bay): an extra bed is provided for children aged under 12, along with an à la carte breakfast.

From 12 years and over, there is an additional charge for the extra bed, which is only available in certain categories of rooms and suites.

There is a separate charge for Guest vehicle parking.

 

Subject to certain conditions, the Hermitage Monte-Carlo and the Hôtel de Paris Monte-Carlo allow dogs, provided they are kept on a leash at all times and do not exceed 7 kilograms in weight. There is a daily charge of 50.00 EUR per animal, and meals are not included. Guests are asked to ensure that their dogs have all of the vaccinations required in the Principality of Monaco and France, and that they do not pose a health or hygiene risk of any kind.

 

Animals are not permitted in restaurants, bars, beaches, or spa facilities at any Resort Hotels.

10. Guest relocation

 

If we are required to move you to an alternative room for technical, safety, or organisational reasons not foreseen when the reservation was made, SBM undertakes to contact you immediately. In all cases, SBM will provide you with accommodation of an equivalent or higher category with facilities and services of the same kind. All of the costs of transferring you to alternative accommodation will be borne by SBM, but no additional compensation will be paid. 

11. Cancellation or reservation changes made by you

 

Reservations can be made via the SBM website or by contact the Customer Service Department directly, depending on the services and season concerned, with or without a cancellation option.

 

If you make a reservation with a cancellation option, you may cancel your reservation at no charge, by contacting the SBM Customer Service Department up to 21/10/7/3 days before your arrival date. Should you cancel after this deadline, depending on the reservation and the season concerned, a penalty will be applied (varying from a single night up to the full reservation amount).

 

These same conditions will apply in the event of a no-show, or if you shorten your stay or check out early.

 

The procedure for cancelling or amending your reservation is indicated when you book and in the confirmation email sent to you by SBM.

 

If you make a reservation without a cancellation option, SBM will not refund your payment, even if you decide to interrupt your stay or check out early for whatever reason, and except in the cases provided for in Article 13, the Hotel will retain your payment for the full price of your stay and for another other purchases made or services used. 

12. No-show

 

Should you fail to show up at the Resort Hotel on the date agreed in your reservation, SBM will invoice you as follows:

- for a non-prepaid reservation: the reservation will be cancelled, the Hotel will make the rooms you reserved available for other customers, and you may not claim compensation of any kind;

A penalty fee will be charged to the credit card you provided as a deposit, in accordance with our cancellation policy.

- for a partially-prepaid reservation: the Hotel will be entitled to retain the prepaid amount by way of compensation, and you are informed that the room will be held for you the first night and until 12 pm the following day. After this period, the Hotel will make the room(s) available for other customers and you may not claim compensation of any kind. You will be charged the balance.

 

- for a fully-prepaid reservation: the Hotel will be entitled to retain the prepaid amount, and you are informed that the room will be held for you the first night and until 12 pm the following day. After this period, the Hotel will make the room(s) available for other customers and you may not claim compensation of any kind.

13. Force majeure

 

The parties accept no liability for non-performance or suspension of their obligations where such non-performance or suspension is attributable to force majeure, meaning an event generally accepted by case law as reasonably preventing the performance of the contractual obligation and which is unforeseeable at the time the reservation is made, including war, periods of national mourning, rioting, demonstrations or protests, strikes, a pandemic resulting in government-mandated travel restrictions, quarantine, or health measures which the party concerned could not reasonably avoid or prevent (quarantine, isolation, testing, health pass, etc.), or an incident affecting its installations.

The party able to claim such force majeure shall advise the other party of the existence of a case of force majeure, immediately and by any written means with proof of delivery.

Where a Guest is affected by a force majeure event, SBM may invite them to postpone their reservation, subject to availability. If no agreement can be reached, the Guest affected by the force majeure event will be permitted to cancel their reservation without charge.

14. Intellectual property

SBM is the owner of the intellectual property rights and holds rights of use to all content on its website, including text, images, graphics, logo, icons, sounds, and software.

Any reproduction, representation, modification, publication, or adaptation of all or part of the website content, by any means whatsoever, is strictly prohibited, except with prior written permission from SBM.
Any unauthorised use of the website or its content will be treated as copyright infringement and may be prosecuted.

15. Disclaimer

 

SBM accepts no liability for partial or total non-performance of the reservation in the event of force majeure as defined in Article 13, or in the case of a fault or breach of contract on the part of the Guest or a third party. This will notably apply in the event that the website becomes unavailable, or where any transaction is refused by your banking institution.

 

SBM accepts no liability in the event of theft, loss, or damage to your personal effects during your stay and concerning services provided by third parties. SBM may not be held liable for direct damage resulting from a wilful act or gross negligence. All other liability is excluded.

 

SBM may not be held liable for any disparities in images, photographs, or editorial content describing the Hotel booked on the website. These elements have no contractual value.

16. Disputes - Applicable law

 

In the event of a dispute arising in relation to these Terms and Conditions and the reservation made by you, the courts of Monaco shall have sole jurisdiction and the laws of Monaco shall apply.

18. Privacy policy

 

Monte-Carlo Société des Bains de Mer attaches great importance to the privacy of its guests, and the protection of their personal information.

 

You are informed that SBM collects personal data in accordance with its “Privacy Policy”, which can be found on the SBM website (www.montecarlosbm.com).

Your personal data may be sent to third parties for the sole purposes of your reservation (these include SBM venues, the Hotel you have booked, electronic payment providers, etc.).

 

The personal data collected are intended for use by SBM, primarily for the purpose of managing your booking and the services provided, and more generally for all aspects of the commercial relationship between you and SBM (consultations, reservations, orders, surveys, information and marketing, statistics).

 

These data will be kept only for as long as is necessary for these purposes, and for a period of no more than three years after the end of the commercial relationship. SBM may also use your data in order to satisfy its legal obligations (particularly in terms of anti-money laundering and fraud) and to meet requests from the public and government authorities.

 

 

Pursuant to Regulation (EU) 2016/679 of 27 April 2016 and Monegasque Act no. 1,165 of 23 December 1993, amended, you have the right of access, the right to rectification, the right to object, the right to erasure, the right to restriction, and the right to portability of your personal data.  By providing proof of your identity, you may exercise these rights by writing to the Data Protection Officer by email at [email protected]. If, after contacting the DPO, you believe your rights have been infringed, you may submit a claim to the French authority, the Commission Nationale de l'Informatique et des Libertés (CNIL.fr), or the Monegasque authority, the Commission de Contrôle des Informations Nominatives (CCIN.mc).
