Contest description:
The Société Anonyme des Bains de Mer et du Cercle des Etrangers in Monaco (“SBM”), Monegasque limited company with a capital of 24.516.661 €, registered in the Trade and Industry Register of Monaco under the number 56 S 523 headquartered Place du Casino – MC 98000 – Principality of Monaco ,is organizing in his hotel establishment (“Monte-Carlo Beach”) a contest with no purchase necessary, called ‘Email Contest 2019’ (“the Contest”).
The Contest will take place at this date:
- from From Monday 1st April to Monday 30 September 2019
The Contest is aimed at individual customers, when traveling for leisure or for business.
The terms and conditions of the Contest are specified in article B.
- Participants
The Contest is open to all customers of legal age who have stayed at Monte-Carlo Beach (cf description of the Contest) on the dates indicated. The Contest can only be accessed at Reception of Monte-Carlo Beach.
Participation in the Contest is not open to members of staff of Monte-Carlo SBM or their families.
Only one entry per person is permitted throughout the Contest.
If the same person stays more than once, only one entry will be accepted.
Participation in the Contest implies acceptance of all of these rules.
B) How to take part
To take part in the Contest:
1- The customer provides their email address (before or during check-in)
2- On arrival at Reception, they verbally confirm their wish to take part to the receptionist
3- Their participation is entered in their customer file on the in-house system by the receptionist
4- The customer receives confirmation of their participation in the Contest by email
C) Rules
The rules of the Contest are sent in a participation confirmation email.
Participants agree to follow the rules and acknowledge that if they breach any of the provisions, SBM may deem their participation null and void.
SBM does not have to give a reason for denying participation and this refusal cannot be challenged.
D) Selection of winners
The winner will be drawn at random on Wednesday 16 October 2019 at 10 am (Paris, France – GMT).
The decision is final and cannot be challenged.
Only Participants who have followed the rules at every stage of the contest will be entered the prize draw.
The winner will receive:
- A stay of 3 consecutive nights for 2 people at the Monte-Carlo Beach, including a double room (subject to availability, and excluding blackout dates) and a buffet bio breakfast at the hotel restaurant.
The winner will receive a prize notification email sent by the Relationship Marketing department: [email protected]
Article 1: Rules
Participation in the Contest implies full and unconditional acceptance of all of these rules (the ‘Rules’), and the laws, orders and other regulations in force in the Principality of Monaco. The Rules therefore apply to all Participants taking part in the Contest and are exclusively subject to Monegasque law.
The Rules are available in the Contest participation confirmation email, received after approval by the relevant departments of Monte-Carlo Beach.
Article 2: Prizes
One (1) winner will be drawn at random and one (1) prize will be allocated in total.
The winner will receive:
A stay of 3 consecutive nights for 2 people at Monte-Carlo Beach, including a double room (subject to availability, and excluding blackout dates) and a buffet bio breakfast at the hotel restaurant.
Article 3: Claiming prizes
The Management of Monte-Carlo Beach may contact the winner directly to give them their ‘invitation’ for the prize described in article 2.
Article 4: Disputes
The SBM has primary jurisdiction for resolving any disputes that may arise during the Contest or relating to the application of these Rules.
The SBM and the Participant will, however, endeavor to resolve amicably any disagreements resulting from the application or interpretation of these Rules before initiating any legal proceedings which, in this case, fall within the jurisdiction of the Courts of the Principality of Monaco, with the sole application of Monegasque law.
Objections will only be accepted within ten days of the declaration of the result.
Article 5: Liability
SBM cannot be held liable if, due to a case of force majeure or an event beyond its control, the dates and/or times relating to the prizes of the Contest have to be changed and/or cancelled.
SBM reserves the right to prosecute anyone who commits or attempts to commit fraud. However, SBM cannot hold Contestants liable for any fraud committed by third parties.
Examples of fraud include a Participant entering and taking part in the Contest under one or more false names or identities borrowed from one or more third parties. All Participants must enter and take part in the Contest under their own name. All cases of fraud result in the elimination of the Participant.
In the event of a breach by a Participant, SBM reserves the right automatically to exclude any entry from that person, without them being able to claim anything.
Article 6: Personal information
Except express agreement of the Participant to receive communications and offers of the Group Monte-Carlo Société des Bains de Mer, any nominative information is intended for SBM, for the purpose of the participation of the Contest.
Pursuant to the amended personal data protection act no. 1,165 of 23 December 1993 modified, about the protection of personal data, and the legislation in the Principality of Monaco, all Participants in the Contest have the right to access, rectify, oppose, deletion of the personal information provided. This right may be exercised by email to [email protected] or by post at Monte-Carlo Société des Bains de Mer, Marketing Department, Place du Casino, B.P. 139, 98000 Monaco.
These personal information provided are kept during the Contest and its effects.
